Article 1 – Definitions
Business / Entrepreneur: PureMycelia, operating from Venlo, The Netherlands.
Consumer: Any natural person acting for purposes outside their trade, business or
profession.
Product: PureMycelia™ premium mycelium grow kit.
Distance Contract: A contract concluded via the webshop.
Reflection Period: The statutory 14-day withdrawal period under EU consumer law

Article 3 – Applicability
These Terms & Conditions apply to every offer and distance contract concluded via www.puremycelia.com.
By placing an order, the consumer agrees to these Terms.
Article 4 – The Offer
Product descriptions and images are provided as accurately as possible. Minor deviations in appearance do not entitle the consumer to compensation or dissolution of the contract.
All offers are subject to availability.
Article 5 – Formation of the Agreement
The agreement is concluded when:
- The consumer completes the checkout process; and
- Payment is successfully received.
The consumer will receive confirmation by email.
Article 6 – Right of Withdrawal
Consumers have a statutory right of withdrawal of 14 days after receiving the product. However, this right does not apply to products that fall under the legal exceptions described in Article 7.
Article 7 – Exclusion of Right of Withdrawal (Important)
The PureMycelia™ grow kit contains live mycelium, a biological product with limited shelf life.
In accordance with EU consumer law, the right of withdrawal does not apply to:
- Perishable goods
- Products subject to rapid deterioration
- Sealed goods unsuitable for return for health or hygiene reasons once opened
Because the grow kit contains living biological material that can deteriorate and is sensitive to storage conditions, it is excluded from the right of withdrawal once delivered.
Returns are therefore not accepted unless the product arrives damaged or defective.
Article 8 – Damaged or Defective Products
If the product arrives visibly damaged or defective:
- The consumer must notify PureMycelia within 48 hours of delivery.
- Clear photographic evidence must be provided.
After verification, PureMycelia may offer a replacement product or a refund.
This does not affect statutory consumer rights.
Article 9 – Pricing
All prices include VAT unless stated otherwise. PureMycelia reserves the right to correct obvious pricing errors.
Article 10 – Delivery
Orders are shipped from the Netherlands. Estimated delivery times are displayed on the website and are indicative only.
Risk transfers to the consumer upon delivery to the provided address. Incorrectly entered shipping details are the responsibility of the consumer.
Article 11 – Secured Delivery Guarantee
PureMycelia offers a secured delivery guarantee for eligible EU destinations. The list of eligible and excluded destinations is available in our FAQ section.
In the rare event of interception by authorities:
- One replacement shipment may be offered;
- If interception occurs again, a refund may be issued.
This guarantee does not apply if incorrect shipping details were provided, the recipient’s name was omitted, or fraudulent information was supplied.
Article 12 – Age Requirement
The minimum age to purchase is 18 years. By placing an order, the consumer confirms they meet this requirement.
Article 13 – Use & Responsibility
The cultivation and any use of mushrooms grown from the kit are entirely the responsibility of the consumer.
Consumers are responsible for verifying compliance with local laws prior to ordering. Effects may vary per individual; PureMycelia cannot guarantee specific outcomes.
Article 14 – Limitation of Liability
PureMycelia is not liable for misuse, improper storage, cultivation errors, or individual reactions. Liability is limited to the purchase amount of the product.
Article 15 – Legal Status
PureMycelia sells mycelium-based grow kits from the Netherlands, where such products are legally placed on the market. Consumers are responsible for ensuring possession and cultivation comply with local regulations.
Article 16 – Complaints
Complaints must be submitted via: support@puremycelia.com
PureMycelia will respond within 14 days of receipt.
Article 17 – Governing Law
These Terms are governed by Dutch law. Mandatory EU consumer protections remain applicable.
Article 18 – Final Provisions
If any provision of these Terms is found invalid, the remaining provisions remain in force.
